Stresul apare c\u00e2nd mecanismul de radiere e l\u0103sat \u201epe dup\u0103\u201d, f\u0103r\u0103 termene, f\u0103r\u0103 documente \u0219i f\u0103r\u0103 o ordine clar\u0103 a pl\u0103\u021bilor.<\/p>\n\n\n\n<p><strong>Ipoteca asupra unui imobil se constituie prin \u00eenscriere \u00een cartea funciar\u0103 \u0219i se stinge, \u00een mod practic, prin radierea din cartea funciar\u0103.<\/strong><\/p>\n\n\n\n<p>Mai jos ai procesul real, \u00een ordinea corect\u0103, cu scenarii \u0219i blocaje.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">1) Ce \u00eenseamn\u0103 ipoteca \u00een cartea funciar\u0103, pentru cump\u0103r\u0103tor<\/h2>\n\n\n\n<p>Ipoteca este un drept real de garan\u021bie \u00een favoarea creditorului (de regul\u0103 banca v\u00e2nz\u0103torului). \u00cen cartea funciar\u0103 (Partea C), ipoteca apare \u00eempreun\u0103 cu creditorul, suma garantat\u0103 \u0219i uneori interdic\u021bii asociate.<\/p>\n\n\n\n<p>C\u00e2nd cumperi cu credit, tranzac\u021bia trebuie s\u0103 produc\u0103 dou\u0103 rezultate simultan:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>ipoteca veche s\u0103 fie radiat\u0103 (sau s\u0103 existe un mecanism care duce la radiere imediat\u0103),<\/li>\n\n\n\n<li>ipoteca b\u0103ncii tale s\u0103 fie \u00eenscris\u0103 dup\u0103 semnare.<\/li>\n<\/ol>\n\n\n\n<p>\u00cen lipsa radierei, banca ta nu poate accepta garan\u021bia \u201ecurat\u0103\u201d, iar notarul nu va autentifica \u00een condi\u021bii normale actul dac\u0103 situa\u021bia nu e clar\u0103.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Te-ar putea interesa \u0219i acest articol despre <a href=\"https:\/\/rentnbuy.com\/blog\/carte-funciara-pe-inteles-sarcini-ipoteca-interdictii-coproprietate\/\">cum cite\u0219ti cartea funciar\u0103.<\/a><\/p>\n<\/blockquote>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">2) Primul pas: verificarea rapid\u0103 \u00een CF \u0219i \u00eentrebarea \u201ecine radiaz\u0103 \u0219i cum\u201d<\/h2>\n\n\n\n<p>\u00cenainte de antecontract, cere un extras CF recent \u0219i verific\u0103:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>cine este creditorul ipotecar (banca v\u00e2nz\u0103torului),<\/li>\n\n\n\n<li>dac\u0103 exist\u0103 \u0219i <strong>interdic\u021bii<\/strong> (de \u00eenstr\u0103inare\/grevare) legate de ipotec\u0103,<\/li>\n\n\n\n<li>dac\u0103 mai apar alte sarcini (nu doar ipoteca).<\/li>\n<\/ul>\n\n\n\n<p>Apoi \u00eentreab\u0103 concret:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201eCare este soldul aproximativ \u0219i cum se stinge la v\u00e2nzare?\u201d<\/li>\n\n\n\n<li>\u201eBanca elibereaz\u0103 declara\u021bie de radiere \u0219i renun\u021bare la rang? \u00cen ce termen?\u201d (acesta este documentul care face radierea posibil\u0103 \u00een CF).<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">3) Documentul cheie: declara\u021bia\/consim\u021b\u0103m\u00e2ntul de radiere al b\u0103ncii v\u00e2nz\u0103torului<\/h2>\n\n\n\n<p>Radierea nu se face \u201epentru c\u0103 s a pl\u0103tit creditul\u201d, ci pe baza unui act al creditorului \u0219i a unei cereri depuse la OCPI. OCPI descrie, \u00een mod direct, c\u0103 radierea ipotecii se face \u00een baza cererii tip \u0219i a \u00eenscrisului corespunz\u0103tor (actul b\u0103ncii).<\/p>\n\n\n\n<p>\u00cen practic\u0103, banca v\u00e2nz\u0103torului emite dup\u0103 stingere:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>o declara\u021bie\/consim\u021b\u0103m\u00e2nt de radiere a ipotecii (de obicei \u00een form\u0103 autentic\u0103 sau \u00een forma cerut\u0103 de OCPI\/notar),<\/li>\n\n\n\n<li>uneori \u0219i \u201erenun\u021bare la rang\u201d (dac\u0103 exist\u0103 situa\u021bii de rang \u00eentre ipoteci).<\/li>\n<\/ul>\n\n\n\n<p>Un reper legal util: Codul civil trateaz\u0103 stingerea ipotecilor \u00een logica \u201eradiere din cartea funciar\u0103\u201d.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">4) Cum se face \u201ef\u0103r\u0103 stres\u201d: ordinea corect\u0103 a pl\u0103\u021bilor \u0219i a \u00eenscrierilor<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Varianta standard, folosit\u0103 des \u00een tranzac\u021bii<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Antecontractul<\/strong> spune clar c\u0103 imobilul se vinde liber de sarcini la data semn\u0103rii finale \u0219i descrie mecanismul de radiere (document banc\u0103 + cerere OCPI).<\/li>\n\n\n\n<li>\u00cenainte de semnare, v\u00e2nz\u0103torul ob\u021bine de la banca lui:\n<ul class=\"wp-block-list\">\n<li>sold\/cont de credit, suma exact\u0103 de rambursare,<\/li>\n\n\n\n<li>instruc\u021biuni de plat\u0103,<\/li>\n\n\n\n<li>confirmarea c\u0103, dup\u0103 \u00eencasare, banca emite actul de radiere.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>La notar, <strong>pre\u021bul se \u00eemparte func\u021bional<\/strong>:\n<ul class=\"wp-block-list\">\n<li>o parte din bani merge direct c\u0103tre banca v\u00e2nz\u0103torului ca s\u0103 sting\u0103 creditul,<\/li>\n\n\n\n<li>restul merge c\u0103tre v\u00e2nz\u0103tor.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Dup\u0103 plata c\u0103tre banca v\u00e2nz\u0103torului \u0219i emiterea actului de radiere, notarul\/ocpi \u00eenscrie:\n<ul class=\"wp-block-list\">\n<li>dreptul t\u0103u de proprietate,<\/li>\n\n\n\n<li>radierea ipotecii vechi,<\/li>\n\n\n\n<li>ipoteca b\u0103ncii tale.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n\n\n<p>Ideea de control: banii care sting ipoteca nu trebuie s\u0103 ajung\u0103 \u201ela v\u00e2nz\u0103tor\u201d, ci la creditorul ipotecar, ca radierea s\u0103 fie automat\u0103, nu negociabil\u0103.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">5) Ce clauze merit\u0103 \u00een antecontract ca s\u0103 nu r\u0103m\u00e2i blocat<\/h2>\n\n\n\n<p>Un antecontract bun nu are multe pagini, are propozi\u021bii clare. Pentru acest scenariu, clauzele care te protejeaz\u0103 sunt:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">A) Clauza \u201eliber de sarcini\u201d cu mecanism, nu doar cu promisiune<\/h3>\n\n\n\n<p>\u201eV\u00e2nz\u0103torul va preda imobilul liber de sarcini la data semn\u0103rii, prin stingerea creditului \u0219i radierea ipotecii \u00een baza actului creditorului \u0219i a cererii de \u00eenscriere.\u201d<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">B) Clauza de calendar<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>termen p\u00e2n\u0103 c\u00e2nd v\u00e2nz\u0103torul furnizeaz\u0103 documentele de la banc\u0103,<\/li>\n\n\n\n<li>termen p\u00e2n\u0103 c\u00e2nd se programeaz\u0103 semnarea,<\/li>\n\n\n\n<li>ce se \u00eent\u00e2mpl\u0103 dac\u0103 banca v\u00e2nz\u0103torului \u00eent\u00e2rzie actul de radiere.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">C) Clauza de avans protejat\u0103<\/h3>\n\n\n\n<p>Dac\u0103 semnezi cu avans, define\u0219te clar c\u00e2nd se restituie dac\u0103 radierea nu se poate face la termen, f\u0103r\u0103 vin\u0103 din partea ta.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">6) Blocaje frecvente \u0219i cum le gestionezi<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Blocaj 1: banca v\u00e2nz\u0103torului \u00eent\u00e2rzie actul de radiere<\/h3>\n\n\n\n<p>Acesta e motivul pentru care vrei termene clare \u0219i dovada c\u0103 procesul a fost ini\u021biat. Obliga\u021bia de radiere \u0219i logica radierei sunt tratate \u00een Codul civil, iar creditorul are obliga\u021bii de radiere \u00een condi\u021biile legii.<\/p>\n\n\n\n<p>Ce faci practic:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>ceri confirmare scris\u0103 de la v\u00e2nz\u0103tor c\u0103 a solicitat actul de radiere,<\/li>\n\n\n\n<li>setezi o dat\u0103 realist\u0103 de semnare sau o prelungire automat\u0103 \u00een antecontract.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Blocaj 2: exist\u0103 interdic\u021bie de \u00eenstr\u0103inare\/grevare legat\u0103 de credit<\/h3>\n\n\n\n<p>Interdic\u021bia poate fi ridicat\u0103 odat\u0103 cu stingerea \u0219i radierea, dar trebuie tratat\u0103 explicit, nu presupus\u0103. Banca ta vrea ipotec\u0103 \u00een rang prioritar \u0219i un imobil f\u0103r\u0103 sarcini concurente.
