C\u00e2nd contractul e opozabil, nu \u00eel po\u021bi \u201escoate\u201d printr-un telefon sau printr-o presiune informal\u0103.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">2) Riscul num\u0103rul unu: contractul de \u00eenchiriere este opozabil noului proprietar<\/h2>\n\n\n\n<p>Codul civil spune c\u0103, dac\u0103 bunul dat \u00een loca\u021biune este \u00eenstr\u0103inat, <strong>dreptul locatarului este opozabil dob\u00e2nditorului<\/strong> \u00een condi\u021bii clare, inclusiv dac\u0103 loca\u021biunea a fost <strong>notat\u0103 \u00een cartea funciar\u0103<\/strong> pentru imobilele \u00eenscrise.<\/p>\n\n\n\n<p>Asta \u00eenseamn\u0103, \u00een practic\u0103:<\/p>\n\n\n\n<ul antecontract, cere un extras CF recent \u0219i verific\u0103 Partea C pentru not\u0103ri\/sarcini care indic\u0103 loca\u021biunea.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">3) Riscul num\u0103rul doi: \u201e\u00eencetarea la v\u00e2nzare\u201d nu func\u021bioneaz\u0103 dac\u0103 nu e scris\u0103 \u0219i dac\u0103 nu respec\u021bi termenele<\/h2>\n\n\n\n<p>Codul civil prevede c\u0103 loca\u021biunea poate \u00eenceta \u00een caz de \u00eenstr\u0103inare <strong>dac\u0103 p\u0103r\u021bile au convenit astfel<\/strong>, \u00eens\u0103 introduce \u0219i o protec\u021bie important\u0103 pentru locatar: chiar \u0219i dup\u0103 notificarea \u00eenstr\u0103in\u0103rii, loca\u021biunea poate r\u0103m\u00e2ne opozabil\u0103 dob\u00e2nditorului pentru o perioad\u0103 raportat\u0103 la termenele de denun\u021bare.<\/p>\n\n\n\n<p>Tradus simplu: <strong>nu te baza pe ideea \u201edup\u0103 ce cump\u0103r, pleac\u0103\u201d.<\/strong> Dac\u0103 vrei un apartament liber, trebuie s\u0103 tratezi eliberarea ca parte din tranzac\u021bie, nu ca un pas ulterior.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">4) Riscul num\u0103rul trei: evacuarea este o procedur\u0103, nu o negociere<\/h2>\n\n\n\n<p>\u00cen Rom\u00e2nia, evacuarea chiria\u0219ului se face legal, \u00een baza unei hot\u0103r\u00e2ri judec\u0103tore\u0219ti, iar procedura implic\u0103 notific\u0103ri \u0219i termene.<br>Codul de procedur\u0103 civil\u0103 include reguli despre notificarea locatarului, inclusiv termene minime pentru notificarea de evacuare, \u00een func\u021bie de durata loca\u021biunii.<\/p>\n\n\n\n<p>Nu intru \u00een strategii litigioase aici, dar ideea practic\u0103 este: <strong>dac\u0103 ai nevoie de apartament liber la o dat\u0103 fix\u0103, nu cump\u0103ra cu chiria\u0219 \u00een el pl\u0103\u021bilor<\/strong> (transferuri, chitan\u021be) pe ultimele 3 luni.<\/li>\n\n\n\n<li><strong>Proces-verbal de predare\/inventar<\/strong> de la intrarea chiria\u0219ului, dac\u0103 exist\u0103 (te ajut\u0103 la garan\u021bie \u0219i daune).<\/li>\n\n\n\n<li><strong>Extras CF recent<\/strong> pentru verificarea not\u0103rilor (loca\u021biune, sarcini).<\/li>\n\n\n\n<li><strong>Situa\u021bia garan\u021biei<\/strong>: cine o de\u021bine, \u00een ce sum\u0103, \u00een ce condi\u021bii se returneaz\u0103.<\/li>\n<\/ol>\n\n\n\n<p><strong>Dac\u0103 v\u00e2nz\u0103torul nu poate produce contractul \u0219i dovada pl\u0103\u021bilor, tu nu cumperi \u201eun apartament cu chiria\u0219\u201d, transfer\u0103 garan\u021bia c\u0103tre tine (sum\u0103, termen, mecanism);<\/li>\n\n\n\n<li>c\u0103 chiria\u0219ul este notificat despre schimbarea proprietarului \u0219i despre noul cont de plat\u0103.<\/li>\n<\/ul>\n\n\n\n<p>Asta transform\u0103 tranzac\u021bia \u00eentr-o preluare ordonat\u0103, nu \u00eentr-un \u201ehai vedem dup\u0103\u201d.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">B) Dac\u0103 vrei apartamentul liber<\/h3>\n\n\n\n<p>Ai nevoie de o condi\u021bie verificabil\u0103, de tip:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201epredare liber de persoane la data X\u201d sau \u201econdi\u021bie suspensiv\u0103: semnarea final\u0103 are loc doar dup\u0103 eliberare\u201d.<\/li>\n<\/ul>\n\n\n\n<p>Dac\u0103 \u00eenchizi tranzac\u021bia \u0219i s\u0103 nu apar\u0103 conflicte<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Notific\u0103 chiria\u0219ul \u00een scris<\/strong> c\u0103 e\u0219ti noul proprietar \u0219i spune clar unde pl\u0103te\u0219te chiria \u0219i utilit\u0103\u021bile.<\/li>\n\n\n\n<li><strong>Semneaz\u0103 un act de preluare a garan\u021biei<\/strong> (tu + v\u00e2nz\u0103tor) \u0219i, ideal,
