Diferen\u021bele mari (mai ales dup\u0103 \u00eenchideri de balcoane sau recompartiment\u0103ri) sunt un motiv clasic de blocaj la credit.<\/li>\n\n\n\n<li><strong>Tipul imobilului<\/strong>: apartament, box\u0103, loc de parcare, teren aferent, p\u0103r\u021bi comune.<\/li>\n<\/ol>\n\n\n\n<p><strong>Dac\u0103 suprafe\u021bele \u0219i identificarea nu sunt coerente \u00een Partea A, nu te baza pe promisiuni, cere clarificare cadastral\u0103 \u00eenainte de antecontract.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">4) Partea B: cine este proprietar \u0219i ce \u00eenseamn\u0103 coproprietate<\/h2>\n\n\n\n<p>\u00cen Partea B urm\u0103re\u0219ti dou\u0103 lucruri: <strong>cine<\/strong> \u0219i <strong>cum<\/strong> de\u021bine.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Proprietar unic<\/h3>\n\n\n\n<p>Ideal pentru vitez\u0103: o singur\u0103 persoan\u0103 semneaz\u0103 \u0219i r\u0103spunde.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Coproprietate<\/h3>\n\n\n\n<p>Coproprietatea nu e problem\u0103, dar schimb\u0103 dinamica:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>dac\u0103 sunt doi coproprietari, ambii trebuie s\u0103 fie alinia\u021bi la v\u00e2nzare sau s\u0103 existe mandat\/procur\u0103 valabil\u0103;<\/li>\n\n\n\n<li>dac\u0103 exist\u0103 cote p\u0103r\u021bi, trebuie s\u0103 fie clar cine vinde ce \u0219i cum se \u00eencaseaz\u0103 pre\u021bul.<\/li>\n<\/ul>\n\n\n\n<p><strong>\u00cen coproprietate, riscul nu este juridic \u00een sine, ci opera\u021bional, adic\u0103 unul dintre coproprietari poate bloca semnarea sau radierea unei sarcini dac\u0103 nu este de acord.<\/strong><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Te poate interesa \u0219i acest articol despre <a href=\"https:\/\/rentnbuy.com\/blog\/cumparare-cu-credit-pasi-si-blocaje\/\">cum cumperi un imobil cu credit.<\/a><\/p>\n<\/blockquote>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">5) Partea C: ce \u00eenseamn\u0103 \u201esarcini\u201d \u0219i de ce conteaz\u0103<\/h2>\n\n\n\n<p>ANCPI define\u0219te extrasul ca incluz\u00e2nd \u201eeventuale sarcini existente asupra imobilului\u201d. \u00cen limbaj de tranzac\u021bie, \u201esarcini\u201d \u00eenseamn\u0103 orice \u00eenscriere care:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>limiteaz\u0103 dreptul de proprietate,<\/li>\n\n\n\n<li>creeaz\u0103 un drept al altcuiva asupra imobilului,<\/li>\n\n\n\n<li>poate bloca v\u00e2nzarea sau creditarea,<\/li>\n\n\n\n<li>creeaz\u0103 un risc juridic.<\/li>\n<\/ul>\n\n\n\n<p>Mai jos sunt cele mai \u00eent\u00e2lnite tipuri, cu modul \u00een care le cite\u0219ti.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">6) Ipoteca: ce \u00eenseamn\u0103, cum te afecteaz\u0103, cum se rezolv\u0103<\/h2>\n\n\n\n<p><strong>Ipoteca imobiliar\u0103 se consider\u0103 constituit\u0103 de la momentul \u00eenscrierii \u00een cartea funciar\u0103.<\/strong> Asta \u00eenseamn\u0103 c\u0103, dac\u0103 vezi ipotec\u0103 \u00een Partea C, exist\u0103 un creditor cu drept real de garan\u021bie.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Ce \u00eentrebi \u0219i ce cau\u021bi<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>care este banca\/creditorul \u0219i suma garantat\u0103;<\/li>\n\n\n\n<li>care este mecanismul de radiere la v\u00e2nzare (se radiaz\u0103 \u00eenainte de semnare sau simultan la notar);<\/li>\n\n\n\n<li>cine suport\u0103 costurile de radiere.<\/li>\n<\/ul>\n\n\n\n<p><strong>Ipoteca nu \u00eenseamn\u0103 automat \u201enu cump\u0103r\u201d, dar \u00eenseamn\u0103 c\u0103 ai nevoie de un plan de radiere scris \u00een antecontract \u0219i sincronizat cu notarul \u0219i banca.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">7) Interdic\u021bia de \u00eenstr\u0103inare \u0219i grevare: de ce apare \u0219i cum te poate bloca<\/h2>\n\n\n\n<p>Interdic\u021biile apar frecvent \u00een:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>contracte de ipotec\u0103,<\/li>\n\n\n\n<li>tranzac\u021bii cu plata \u00een rate c\u0103tre dezvoltator,<\/li>\n\n\n\n<li>dona\u021bii cu clauze,<\/li>\n\n\n\n<li>situa\u021bii speciale prev\u0103zute de reglement\u0103ri tehnice\/administrative.<\/li>\n<\/ul>\n\n\n\n<p>Regulamentul ANCPI (ODG 700\/2014, publicat de ANCPI) are formul\u0103ri explicite despre notarea \u201einterdic\u021biei de \u00eenstr\u0103inare \u0219i de grevare\u2026 p\u00e2n\u0103 la plata integral\u0103 a pre\u021bului \u0219i a dob\u00e2nzii\u201d.<\/p>\n\n\n\n<p><strong>O interdic\u021bie notat\u0103 nu este un \u201edetaliu\u201d, este o condi\u021bie; dac\u0103 exist\u0103, trebuie s\u0103 \u0219tii cine o poate ridica, \u00een ce moment \u0219i pe ce document.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">8) Alte sarcini frecvente care merit\u0103 traduse \u00een limbaj simplu<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Servitute<\/h3>\n\n\n\n<p>Un drept al altcuiva de a folosi o parte din imobil (de exemplu acces). Un litigiu sau un sechestru poate bloca v\u00e2nzarea sau poate crea riscuri pe care nu le \u201erezolvi\u201d printr o negociere de pre\u021b.<\/p>\n\n\n\n<p><strong>Dac\u0103 \u00een Partea C apare litigiu sau sechestru, ai nevoie de consult juridic \u0219i, \u00een cele mai multe cazuri, de evitarea tranzac\u021biei p\u00e2n\u0103 la clarificare.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">9) Not\u0103ri: ce sunt \u0219i de ce pot schimba tranzac\u021bia<\/h2>\n\n\n\n<p>Codul civil enumer\u0103 tipuri de acte sau fapte care pot fi notate \u00een cartea funciar\u0103 (de exemplu inten\u021bia de a \u00eenstr\u0103ina, antecontracte, pacte de op\u021biune).<\/p>\n\n\n\n<p>Ce \u00eenseamn\u0103 pentru tine: unele not\u0103ri nu sunt \u201esarcini\u201d \u00een sens de ipotec\u0103, dar sunt <strong>informa\u021bii care arat\u0103 c\u0103 exist\u0103 deja o promisiune, o inten\u021bie sau un drept \u00een favoarea altcuiva<\/strong>.
