Ele au termene diferite \u0219i documente diferite. O regul\u0103 u\u0219or de re\u021binut este aceasta: <strong>C168 este pentru \u00eenregistrarea contractului \u00een 30 de zile, iar D212 este pentru declararea veniturilor \u0219i contribu\u021biilor p\u00e2n\u0103 la 25 mai (pentru anul anterior)<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">1) \u00cenregistrarea contractului la ANAF: ce este \u0219i care e termenul<\/h2>\n\n\n\n<p><strong>\u00cenregistrarea contractului de loca\u021biune<\/strong> \u00eenseamn\u0103 depunerea unei cereri la ANAF, \u00eempreun\u0103 cu copia contractului. Formularul folosit este <strong>C168 \u2013 Cerere de \u00eenregistrare a contractelor de loca\u021biune<\/strong>, publicat \u0219i men\u021binut de ANAF.<\/p>\n\n\n\n<p><strong>Termenul standard de \u00eenregistrare este de cel mult 30 de zile<\/strong> de la \u00eencheierea contractului sau de la producerea unei modific\u0103ri (act adi\u021bional). Aceast\u0103 regul\u0103 este inclus\u0103 \u00een procedura aferent\u0103 OPANAF 161\/2025 \u0219i \u00een anexele de procedur\u0103.<\/p>\n\n\n\n<p><strong>Dac\u0103 semnezi azi contractul (sau un act adi\u021bional), fereastra de conformare pentru C168 este de 30 de zile, nu \u201ep\u00e2n\u0103 la finalul anului\u201d.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">2) Cine depune C168, mai ales dac\u0103 sunt coproprietari<\/h2>\n\n\n\n<p>Procedura C168 spune explicit c\u0103 cererea se depune de:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>contribuabilii care ob\u021bin venituri din cedarea folosin\u021bei bunurilor \u0219i au obliga\u021bia de \u00eenregistrare;<\/li>\n\n\n\n<li>contribuabilii desemna\u021bi \u00een cazul \u00een care bunul este de\u021binut \u00een comun (coproprietate), de regul\u0103 un proprietar\/uzufructuar sau alt de\u021bin\u0103tor legal desemnat.<\/li>\n<\/ul>\n\n\n\n<p>Din 2025, OUG 128\/2024 clarific\u0103 mecanismul pentru bunurile de\u021binute \u00een comun: <strong>prin contract se desemneaz\u0103 persoana care \u00eendepline\u0219te obliga\u021bia de \u00eenregistrare<\/strong>.<\/p>\n\n\n\n<p><strong>Dac\u0103 apartamentul are doi proprietari, contractul ar trebui s\u0103 spun\u0103 explicit cine depune C168, iar \u00een C168 se trec locatorii \u0219i cotele lor astfel \u00eenc\u00e2t totalul s\u0103 fie 100%.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">3) Ce depui, concret, \u0219i ce ata\u0219ezi la C168<\/h2>\n\n\n\n<p>\u00cen practic\u0103, pachetul minim este:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>C168 completat<\/strong> (date locator\/locatar, date contract);<\/li>\n\n\n\n<li><strong>copie a contractului de \u00eenchiriere<\/strong> (\u0219i copia actului adi\u021bional, dac\u0103 \u00eenregistrezi o modificare).<\/li>\n<\/ul>\n\n\n\n<p>ANAF are \u0219i o pagin\u0103 dedicat\u0103 formularului web C168, util\u0103 pentru completare \u0219i generare document.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">4) Ce modific\u0103ri trebuie \u00eenregistrate din nou<\/h2>\n\n\n\n<p>Regula de 30 de zile se aplic\u0103 \u0219i la modific\u0103ri. \u00cen practic\u0103, se \u00eenregistreaz\u0103 prin C168 c\u00e2nd se schimb\u0103 elemente relevante ale contractului, cum ar fi:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>valoarea chiriei;<\/li>\n\n\n\n<li>durata;<\/li>\n\n\n\n<li>p\u0103r\u021bile;<\/li>\n\n\n\n<li>adresa \/ obiectul;<\/li>\n\n\n\n<li>alte clauze contractuale care schimb\u0103 raportul de loca\u021biune.<\/li>\n<\/ul>\n\n\n\n<p>Principiul este simplu: <strong>dac\u0103 ai f\u0103cut act adi\u021bional, trateaz\u0103-l ca pe un \u201enou eveniment\u201d fiscal \u0219i depune C168 \u00een 30 de zile.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">5) Taxele pe chirie: cum se calculeaz\u0103 impozitul \u00een regimul clasic<\/h2>\n\n\n\n<p>Pentru veniturile din <strong>cedarea folosin\u021bei bunurilor<\/strong> (chirie \u201eclasic\u0103\u201d), impozitul anual este <strong>10% aplicat la venitul net anual<\/strong>.<\/p>\n\n\n\n<p>\u00cen regimul standard folosit \u00een materiale ANAF, venitul net se determin\u0103 cu <strong>deducere forfetar\u0103 de 20% din venitul brut<\/strong>, ceea ce duce la o formul\u0103 foarte simpl\u0103:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Venit brut anual<\/strong> = chirie lunar\u0103 \u00d7 num\u0103r luni \u00eencasate<\/li>\n\n\n\n<li><strong>Venit net anual<\/strong> = venit brut \u00d7 80% (deducere 20%)<\/li>\n\n\n\n<li><strong>Impozit anual<\/strong> = 10% \u00d7 venit net anual<\/li>\n<\/ul>\n\n\n\n<p><strong>\u00cen <a href=\"https:\/\/rentnbuy.com\/\">chirii<\/a> clasice, impozitul nu se aplic\u0103 direct pe chiria brut\u0103, ci pe venitul net ob\u021binut dup\u0103 deducerea forfetar\u0103 de 20%.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">6) Declara\u021bia Unic\u0103 (D212): c\u00e2nd se depune \u0219i pentru ce<\/h2>\n\n\n\n<p>Bro\u0219ura ANAF despre Declara\u021bia Unic\u0103 precizeaz\u0103 c\u0103 <strong>D212 se depune p\u00e2n\u0103 la 25 mai 2026 inclusiv<\/strong> pentru declararea venitului realizat \u0219i stabilirea\/definitivarea impozitului anual \u0219i a contribu\u021biilor sociale.<\/p>\n\n\n\n<p><strong>D212 este declara\u021bia prin care persoana fizic\u0103 declar\u0103 veniturile realizate \u0219i, dup\u0103 caz, contribu\u021biile datorate, cu termen de depunere p\u00e2n\u0103 la 25 mai a anului urm\u0103tor.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">7) CASS la chirii: c\u00e2nd apare \u0219i cum verifici pragurile<\/h2>\n\n\n\n<p>Pentru veniturile din cedarea folosin\u021bei bunurilor, <strong>CASS se datoreaz\u0103 \u00een func\u021bie de \u00eencadrarea venitului net anual \u00een pragurile de cel pu\u021bin 6, 12 sau 24 de salarii minime brute pe \u021bar\u0103<\/strong>, iar \u00eencadrarea se face prin cumularea veniturilor relevante (conform regulilor din Codul fiscal, reflectate \u00een materialele ANAF).<\/p>\n\n\n\n<p><strong>CASS nu apare la orice chirie, ci apare c\u00e2nd venitul net anual cumulat trece de pragurile 6\/12\/24 salarii minime, iar obliga\u021bia se declar\u0103 \u00een D212.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">8) Situa\u021bie special\u0103: c\u00e2nd chiria este pl\u0103tit\u0103 de o firm\u0103<\/h2>\n\n\n\n<p>Dac\u0103 chiria este pl\u0103tit\u0103 de <strong>persoane juridice sau alte entit\u0103\u021bi care au obliga\u021bia de a conduce eviden\u021b\u0103 contabil\u0103<\/strong>, exist\u0103 situa\u021bii \u00een care <strong>Declara\u021bia Unic\u0103 nu se depune de beneficiar<\/strong>, deoarece impunerea este final\u0103 conform regimului aplicabil acestor venituri pl\u0103tite de entit\u0103\u021bi cu eviden\u021b\u0103 contabil\u0103.<\/p>\n\n\n\n<p>\u00cen plus, ANAF are materiale care trateaz\u0103 separat \u201ecalculul impozitului\u201d c\u00e2nd chiria\u0219ul este persoan\u0103 juridic\u0103 sau alt\u0103 entitate cu eviden\u021b\u0103 contabil\u0103.<\/p>\n\n\n\n<p><strong>\u00cen contractele cu chiria\u0219 persoan\u0103 juridic\u0103, verific\u0103 explicit dac\u0103 impozitul este re\u021binut la surs\u0103 de pl\u0103titor \u0219i ce obliga\u021bii declarative \u00ee\u021bi r\u0103m\u00e2n \u021bie ca
