De aici apar cele mai frecvente conflicte: chirie nepl\u0103tit\u0103, garan\u021bii nerecuperate, repara\u021bii contestate, evacu\u0103ri for\u021bate sau vizite neanun\u021bate.<\/p>\n\n\n\n<p>Contractul de \u00eenchiriere apartament nu este un simplu \u201eformular de completat\u201d, ci structura de baz\u0103 care define\u0219te rela\u021bia dintre proprietar \u0219i chiria\u0219. Modul \u00een care este scris contractul influen\u021beaz\u0103 c\u00e2t de u\u0219or se rezolv\u0103 orice situa\u021bie nepl\u0103cut\u0103 ulterior.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Ce este, de fapt, un contract de \u00eenchiriere<\/h3>\n\n\n\n<p>Contractul de \u00eenchiriere (sau contract de loca\u021biune) este acordul scris prin care proprietarul (locatorul) ofer\u0103 dreptul de folosin\u021b\u0103 asupra unui apartament, pentru o perioad\u0103 determinat\u0103, \u00een schimbul unei sume de bani (chiria). Este reglementat \u00een principal de Codul Civil \u0219i de Legea locuin\u021bei \u0219i poate fi \u00eencheiat pe durat\u0103 determinat\u0103 sau nedeterminat\u0103.<\/p>\n\n\n\n<p>Contractul de \u00eenchiriere apartament nu trebuie autentificat la notar pentru a fi valabil. Este suficient s\u0103 fie redactat \u00een form\u0103 scris\u0103 \u0219i semnat de ambele p\u0103r\u021bi. Autentificarea notarial\u0103 r\u0103m\u00e2ne o op\u021biune, nu o obliga\u021bie, folosit\u0103 \u00een general atunci c\u00e2nd p\u0103r\u021bile vor o prob\u0103 suplimentar\u0103 \u00een caz de litigiu.<\/p>\n\n\n\n<p>Un contract scris nu este doar o formalitate fiscal\u0103. \u00cen lipsa lui, este greu de dovedit:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>care era chiria real\u0103<\/li>\n\n\n\n<li>ce bunuri existau \u00een apartament la predare<\/li>\n\n\n\n<li>cine suporta anumite tipuri de repara\u021bii<\/li>\n\n\n\n<li>ce termen de preaviz s-a agreat<\/li>\n<\/ul>\n\n\n\n<p>Practic, f\u0103r\u0103 contract, orice disput\u0103 devine \u201ecuv\u00e2nt contra cuv\u00e2nt\u201d.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Ce trebuie s\u0103 con\u021bin\u0103 un contract de \u00eenchiriere apartament<\/h3>\n\n\n\n<p>Un model de contract de \u00eenchiriere poate fi adaptat, dar anumite elemente nu ar trebui s\u0103 lipseasc\u0103:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>datele p\u0103r\u021bilor: nume, adres\u0103, CNP \/ date de identificare firm\u0103<\/li>\n\n\n\n<li>descrierea apartamentului: adres\u0103, num\u0103r cadastral, suprafa\u021b\u0103, dot\u0103ri relevante<\/li>\n\n\n\n<li>durata \u00eenchirierii: de exemplu 12 luni, cu sau f\u0103r\u0103 prelungire automat\u0103<\/li>\n\n\n\n<li>valoarea chiriei: sum\u0103 lunar\u0103, data pl\u0103\u021bii, modalitatea (numerar, transfer bancar)<\/li>\n\n\n\n<li>garan\u021bia: valoare, c\u00e2nd se pl\u0103te\u0219te, \u00een ce condi\u021bii se restituie<\/li>\n\n\n\n<li>cheltuieli \u0219i utilit\u0103\u021bi: cine pl\u0103te\u0219te \u00eentre\u021binerea, energia, gazul, internetul<\/li>\n\n\n\n<li>obliga\u021biile p\u0103r\u021bilor: ce repara\u021bii revin proprietarului, ce repara\u021bii revin chiria\u0219ului<\/li>\n\n\n\n<li>condi\u021biile de reziliere: la ce tip de \u00eenc\u0103lcare contractual\u0103 poate \u00eenceta contractul<\/li>\n<\/ul>\n\n\n\n<p>De multe ori, inventarul anexat la contract c\u00e2nt\u0103re\u0219te mai mult dec\u00e2t pare. O list\u0103 detaliat\u0103 a bunurilor \u0219i eventual fotografii f\u0103cute la predare reduc disputele la finalul \u00eenchirierii.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Beneficiile contractului pentru chiria\u0219<\/h3>\n\n\n\n<p>Pentru chiria\u0219, un contract de \u00eenchiriere apartament bine scris \u00eenseamn\u0103, \u00een primul r\u00e2nd, predictibilitate:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>drept de folosin\u021b\u0103 lini\u0219tit\u0103 \u0219i netulburat\u0103: proprietarul nu poate intra \u00een locuin\u021b\u0103 oric\u00e2nd dore\u0219te, ci doar cu acord prealabil<\/li>\n\n\n\n<li>chirie stabilit\u0103 clar: suma \u0219i termenul de plat\u0103 sunt cunoscute, iar modific\u0103rile se pot face doar prin acord<\/li>\n\n\n\n<li>protec\u021bie fa\u021b\u0103 de evacu\u0103ri bru\u0219te: contractul \u0219i clauzele de preaviz \u00eempiedic\u0103 situa\u021biile de tip \u201ete rog s\u0103 pleci de s\u0103pt\u0103m\u00e2na viitoare\u201d<\/li>\n\n\n\n<li>clarificarea repara\u021biilor: chiria\u0219ul \u0219tie ce \u00eei revine (repara\u021bii m\u0103runte) \u0219i ce r\u0103m\u00e2ne \u00een sarcina proprietarului (defec\u021biuni de instala\u021bii, probleme structurale)<\/li>\n\n\n\n<li>recuperarea garan\u021biei: dac\u0103 nu exist\u0103 daune \u0219i nu sunt restan\u021be, exist\u0103 un temei clar pentru restituirea sumei<\/li>\n<\/ul>\n\n\n\n<p>\u00cen absen\u021ba contractului, chiria\u0219ul are pu\u021bine instrumente de ap\u0103rare \u00een fa\u021ba unor abuzuri: cre\u0219teri arbitrare de chirie, refuz de repara\u021bii, intr\u0103ri neanun\u021bate \u00een locuin\u021b\u0103.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Beneficiile contractului pentru proprietar<\/h3>\n\n\n\n<p>Pentru proprietar, contractul este, \u00een esen\u021b\u0103, instrumentul prin care \u00ee\u0219i protejeaz\u0103 investi\u021bia:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>poate solicita plata chiriei la termen \u0219i poate condi\u021biona continuarea contractului de respectarea obliga\u021biilor<\/li>\n\n\n\n<li>poate \u00eencasa o garan\u021bie \u00eenscris\u0103 clar \u00een document, pe care o poate folosi pentru acoperirea daunelor sau a restan\u021belor<\/li>\n\n\n\n<li>are un temei pentru a solicita \u00een instan\u021b\u0103 evacuarea chiria\u0219ului, dac\u0103 acesta nu pl\u0103te\u0219te sau deterioreaz\u0103 grav imobilul<\/li>\n\n\n\n<li>poate stabili reguli clare privind folosirea apartamentului (num\u0103r de persoane, animale de companie, lucr\u0103ri de modificare)<\/li>\n\n\n\n<li>poate cere desp\u0103gubiri pe baza contractului \u0219i a procesului-verbal de predare-primire<\/li>\n<\/ul>\n\n\n\n<p>Un proprietar care \u00eenchiriaz\u0103 \u201ef\u0103r\u0103 acte\u201d \u00ee\u0219i asum\u0103, \u00een realitate, cel mai mare risc: dac\u0103 apar restan\u021be sau distrugeri, recuperarea prejudiciului devine dificil\u0103 \u0219i, uneori, imposibil\u0103.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Documentele necesare la \u00eenchirierea unui apartament<\/h3>\n\n\n\n<p>\u00cen mod obi\u0219nuit, p\u0103r\u021bile au nevoie de:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>pentru proprietar: act de identitate, act de proprietate asupra apartamentului<\/li>\n\n\n\n<li>pentru chiria\u0219: act de identitate; uneori, dovada veniturilor (pentru credibilitatea capacit\u0103\u021bii de plat\u0103)<\/li>\n<\/ul>\n\n\n\n<p>La acestea se adaug\u0103:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>contractul de \u00eenchiriere<\/li>\n\n\n\n<li>proces-verbal de predare-primire (inventar, citiri contoare, starea bunurilor)<\/li>\n\n\n\n<li>op\u021bional: certificat energetic, poli\u021b\u0103 de asigurare, informare c\u0103tre asocia\u021bia de proprietari cu privire la noul chiria\u0219<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">\u00cenregistrarea contractului de \u00eenchiriere la ANAF<\/h3>\n\n\n\n<p>\u00cencep\u00e2nd cu modific\u0103rile fiscale recente, contractele de \u00eenchiriere trebuie declarate la ANAF \u00eentr-un termen limit\u0103 de la semnare. Scopul este dublu: statul urm\u0103re\u0219te \u00eenregistrarea veniturilor din chirii, iar proprietarul beneficiaz\u0103 de un cadru fiscal clar.<\/p>\n\n\n\n<p>Procedura presupune, \u00een linii mari:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>completarea contractului de \u00eenchiriere \u0219i, dup\u0103 caz, a formularului specific (de tip C168 \/ 168)<\/li>\n\n\n\n<li>depunerea documentelor la ANAF sau transmiterea lor prin Spa\u021biul Privat Virtual<\/li>\n\n\n\n<li>actualizarea datelor \u00een cazul modific\u0103rii chiriei sau a duratei, prin acte adi\u021bionale<\/li>\n<\/ul>\n\n\n\n<p>Ne\u00eenregistrarea contractului nu \u00eel face inexistent \u00eentre p\u0103r\u021bi, dar poate atrage consecin\u021be fiscale: impozit suplimentar, penalit\u0103\u021bi, eventuale verific\u0103ri.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Ce se \u00eent\u00e2mpl\u0103 f\u0103r\u0103 contract sau f\u0103r\u0103 \u00eenregistrare<\/h3>\n\n\n\n<p>\u00cen lipsa contractului de \u00eenchiriere apartament:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>proprietarul nu are un instrument clar pentru a cere evacuarea chiria\u0219ului sau desp\u0103gubiri<\/li>\n\n\n\n<li>chiria\u0219ul nu poate dovedi ce sum\u0103 pl\u0103te\u0219te, ce garan\u021bie a depus sau ce promisiuni au fost f\u0103cute<\/li>\n\n\n\n<li>disputele privind starea apartamentului, bunuri lips\u0103 sau utilit\u0103\u021bi neachitate devin greu de clarificat<\/li>\n<\/ul>\n\n\n\n<p>\u00cen lipsa \u00eenregistr\u0103rii fiscale, riscurile se mut\u0103 \u00een zona rela\u021biei cu ANAF: venituri nedeclarate, impozite calculate retroactiv, penalit\u0103\u021bi.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Garan\u021bia la contractul de \u00eenchiriere<\/h3>\n\n\n\n<p>Garan\u021bia este, \u00een practic\u0103, una dintre cele mai sensibile zone ale rela\u021biei proprietar\u2013chiria\u0219. De regul\u0103, suma reprezint\u0103 echivalentul unei chirii lunare, pl\u0103tit\u0103 la \u00eenceputul contractului.<\/p>\n\n\n\n<p>Contractul ar trebui s\u0103 precizeze clar:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>suma garan\u021biei<\/li>\n\n\n\n<li>\u00een ce condi\u021bii se re\u021bine (daune, restan\u021be, facturi nepl\u0103tite)<\/li>\n\n\n\n<li>\u00een ce termen se restituie dup\u0103 eliberarea locuin\u021bei<\/li>\n<\/ul>\n\n\n\n<p>Situa\u021bia frecvent \u00eent\u00e2lnit\u0103 \u201enu mai pl\u0103tesc ultima lun\u0103, lu\u0103m din garan\u021bie\u201d ar trebui agreat\u0103 explicit de ambele p\u0103r\u021bi, nu l\u0103sat\u0103 la nivel de \u00een\u021belegere verbal\u0103.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Cum \u00eenceteaz\u0103 un contract de \u00eenchiriere apartament<\/h3>\n\n\n\n<p>Contractul nu este \u201epe via\u021b\u0103\u201d. El poate \u00eenceta \u00een mai multe moduri:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>prin ajungerea la termen<\/strong>: la expirarea duratei stabilite, f\u0103r\u0103 alte formalit\u0103\u021bi, dac\u0103 p\u0103r\u021bile nu decid altceva<\/li>\n\n\n\n<li><strong>prin denun\u021bare cu preaviz<\/strong>: una dintre p\u0103r\u021bi anun\u021b\u0103 \u00een scris c\u0103 dore\u0219te \u00eencetarea, respect\u00e2nd termenele prev\u0103zute \u00een contract sau \u00een Codul Civil<\/li>\n\n\n\n<li><strong>prin reziliere<\/strong>: c\u00e2nd una dintre p\u0103r\u021bi nu \u00ee\u0219i respect\u0103 obliga\u021biile (de exemplu, chiria\u0219ul nu pl\u0103te\u0219te chiria, proprietarul refuz\u0103 constant repara\u021biile majore), cealalt\u0103 parte poate cere \u00eencetarea contractului<\/li>\n<\/ul>\n\n\n\n<p>\u00cen practic\u0103, un contract de \u00eenchiriere apartament bine scris include clauze explicite legate de:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>termenul de preaviz pentru chiria\u0219 (c\u00e2nd vrea s\u0103 plece mai devreme)<\/li>\n\n\n\n<li>termenul \u0219i condi\u021biile de preaviz pentru proprietar<\/li>\n\n\n\n<li>ce \u00eenseamn\u0103 \u201e\u00eenc\u0103lcare grav\u0103\u201d a obliga\u021biilor \u0219i ce efecte are<\/li>\n<\/ul>\n\n\n\n<p>Aceste clarific\u0103ri reduc riscul de surprize nepl\u0103cute pentru ambele p\u0103r\u021bi.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">\u00centreb\u0103ri frecvente despre contractul de \u00eenchiriere apartament<\/h3>\n\n\n\n<p><strong>Este obligatoriu contractul de \u00eenchiriere \u00een form\u0103 scris\u0103?<\/strong><br>Da, \u00een practic\u0103 este esen\u021bial.
